REGULATIONS UNDER THE COMMONWEALTH BANKS ACT 1959-1974.*

I, THE GOVERNOR-GENERAL of Australia, acting with the advice of the Executive Council, hereby make the following Regulations under the Commonwealth Banks Act 1959-1974.

COMMONWEALTH BANKS (ALLOWANCES) REGULATIONS

Citation.

1. These Regulations may be cited as the Commonwealth Banks (Allowances) Regulations.

Commencement.

2. These Regulations shall be deemed to have come into operation on 18 October 1974.

Definition.

3. In these Regulations—

“ member of the Commonwealth Banking Corporation Board ” means a member of the Commonwealth Banking Corporation Board referred to in paragraph 14 (1) (d) of the Act;

“ the Act ” means the Commonwealth Banks Act 1959-1974.

Travelling allowance.

4. (1) Subject to regulation 7, where the holder of an office specified in Schedule 1 is, inthe course of performing the duties of his office, necessarily absent overnight from the city in which he normally resides, travelling allowance is payable to him at the rate of $34 per day.

(2) Subject to regulations 5 and 7, where the holder of an office specified in Schedule 2 is, in the course of performing the duties of his office, necessarily absent overnight from the city in which he normally resides, travelling allowance ispayable to him at the rate of $28 per day.

(3) Travelling allowance payable under this regulation is in addition to, and does not include, the cost of conveyance.

Travelling allowance—existing members of Commonwealth Banking Corporation Board.

5. Where a member of the Commonwealth Banking Corporation Board, being a person who was the holder of that office immediately before the commencement of the Commonwealth Banks Act 1974, is, in the course of performing the duties of his office, necessarily absent overnight from the city in which he normally resides, travelling allowance is payable to him at the rate of $34 per day.

Other allowances.

6. (1) Subject to regulation 7, the holder of an office specified in Schedule 1, is entitled to be paid such allowances, other than travelling allowance, as would be payable to him under the Public Service Regulations, as in force from time to time, if he were the Permanent Head of the Department of the Treasury.

(2) Subject to regulation 7, a member of the Commonwealth Banking Corporation Board is entitled to be paid such allowances, other than travelling allowance, as would be payable to him under the Public Service Regulations, as in force from time to time, if he were an officer of the Australian Public Service and were included in the Second Division.

Allowance in respect of service outside Australia.

7. (1) Where the bolder of an office specified in Schedule 1 performs the duties of his office outside Australia and the external Territories, he is entitled to be paid such allowances as he would be entitled to be paid if he were the Permanent Head of the Department of the Treasury.

(2) Where a member of the Commonwealth Banking Corporation Board performs the duties of his office outside Australia and the external Territories, he is entitled to be paid such allowances as he would be entitled to be paid if he were an officer of the Australian Public Service and were included in the Second Division.

(3) A person who is entitled to be paid travelling allowance in respect of a period under sub-regulation (1) or (2), is not entitled to be paid travelling allowance in respect of that period under regulation 4 or 5.
