2 Commonwealth Aluminium Corporation Pty. Limited Agreement No. 105, 1993 ˙ Short title 1. This regulation may be cited as the Commonwealth Aluminium Corporation Pty. Limited Agreement Regulation 1993 . ˙ Definition 2. In this regulation— “principal agreement” means the agreement mentioned in section 2 of the Act as varied under section 4 of the Act. ˙ Variation approved 3. The variation of the principal agreement as provided for in the agreement set out in the Schedule is approved.

Limited Agreement No. 105, 1993 ¡ SCHEDULE AGREEMENT section 3 THE AGREEMENT is made the 30th day of March 1993 BETWEEN THE HONOURABLE THE MINISTER FOR MINERALS AND ENERGY of the State of Queensland, being the Minister for the time being administering “The CommonwealthAluminiumCorporationPtyLimitedAgreement Act 1957” of the said State of the One Part, AND COMALCO ALUMINIUM LIMITED , a company incorporated in the said State formerly as Commonwealth Aluminium Corporation Pty Limited which has its office at Floor 15, 12 Creek Street, Brisbane, in the said State (hereinafter called “the Company” which expression shall include its successors and permitted assigns) of the Other Part; WHEREAS on the 16th day of December 1957 the State of Queensland and the Company pursuant to the authority contained in section 2 of the said Act entered into an agreement which is set out in The Schedule to the said Act and which is hereinafter called “the Principal Agreement”; AND WHEREAS pursuant to the provisions of section 4 of the said Act the Principal Agreement may be varied by agreement between the Minister and the Company with the approval of the Governor in Council; AND WHEREAS the Principal Agreement has previously been varied by agreements made with the approval of the Governor in Council by Orders in Council published in the Government Gazette; AND WHEREAS it has now become desirable for the Principal Agreement as previously varied to be further varied:

Limited Agreement No. 105, 1993 NOW THEREFORE, ON AND FROM THE DATE HEREOF IT IS AGREED AS FOLLOWS: Clause 56 of the Principal Agreement (as previously varied) is amended by inserting after paragraph (b) thereof the following paragraph: “ (c) The Company is empowered to grant to the Commonwealth of Australia (hereinafter called “the Commonwealth”) a licence in terms of the Tenth Schedule to an agreement made the 18th day of December 1992 between the Commonwealth, the State and the Company ”. IN WITNESS WHEREOF the parties hereto have executed this Agreement as at the day and year first above written.
