FRENCH CJ:   This appeal from the Court of Appeal of the Supreme Court of Northern Territory was heard in Brisbane on 23 June 2009 by a Court constituted by Justices Hayne, Heydon, Crennan, Kiefel and myself.  The appeal was heard together with the appeal in Alcan (NT) Alumina Pty Ltd v Commissioner of Territory Revenue [2009] HCA 41. Following delivery of judgment in that appeal, the parties have filed a consent to orders dismissing the present appeal with costs.

Pursuant to rule 8.04.3 of the High Court Rules I direct the Registrar to draw up, sign and seal an order in accordance with the terms of the consent.
