MR McCARTHY: It appears that both of these gentlemen are

performing under their probation orders. I am writing a 1

formal letter to the Commissioner of Police advising the value in pursuing the appeal. I don't think the appeal will set any precedent, even if it was allowed in the circumstances. I am merely asking for some time for the Commissioner's office to consider the material that I have and to consider my legal advice to you.
