T h a t o f c o u r s e i s n o t t o s a y t h a t h e n e c e s s a r i l y w o u l d l i e t o t h i s

t r i b u n a l b u t i t d o e s f o l l o w t h a t h i s e v i d e n c e m u s t b e s c r u t i n i s e d

w i t h e x t r e m e c a r e . T h e r e i s l i t t l e c o r r o b o r a t i o n o f h i s a l l e g a t i o n s .

M r S i n g h who n o d o u b t b e c a u s e o f h i s own p r o b l e m s a d o p t e d a r a t h e r

I t i s d i f f i c u l t t o b e i m p r e s s e d w i t h h i s e v i d e n c e a n d I was n o t

i m p r e s s e d by i t , e s p e c i a l l y i n t h e l i g h t o f i n t e r a l i a M r D i c k i e ' s

o b s e r v a t i o n s t h a t t h e r e was no s i g n o f i n j u r y o r o f c r y i n g . I

h a v e	n o	d i f f i c u l t y i n a c c e p t i n g M r D i c k i e	a s a	p e r s o n	who	would
make	a	r e l i a b l e o b s e r v a t i o n and	a s a w i t n e s s	o f	t r u t h .	H i s comment
i s v e r i f i e d by	t h e o b s e r v a t i o n s	o f	D r B r a c k e n .	H i s was	a	d e t a i l e d

e x a m i n a t i o n	made	f o r a	p u r p o s e	on	1 7 J u l y .	H e	f o u n d	some
s e n s i t i v i t y	t o	t o u c h	b u t	n o t h i n g	o b j e c t i v e .	H e f o u n d	no	s e n s i t i v i t y

C o n s t a b l e Dawes n o t e d h t s hand up t o h i s f a c e b u t saw

n o s i g n o r m a r k s o r t e a r s . C o n s t a b l e P e n d l e b u r y a t 7:45 p.m.

o b s e r v e d s l i g h t s w e l l i n g u n d e r t h e e y e a n d s l i g h t a b r a s i o n . On

t h e f o l l o w i n g	d a y	a t 4:00	p.m.	h e n o t e d	t h a t	t h e s w e l l i n g h a d	g o n e
down	s u b s t a n t i a l l y ,	b u t	h e	d i d	d e f e r t o t h e o b s e r v a t i o n s	o f	d o c t o r s .

M r Gander a n d M r J o h n s o n , b o t h g a v e e v i d e n c e . I was

n o t u n i m p r e s s e d w i t h t h e m a n n e r i n w h i c h b o t h o f f i c e r s g a v e t h e i r

e v i d e n c e , n o t w i t h s t a n d i n g e x p e r t b u t s c r u p u l o u s l y f a i r c r o s s -

e x a m i n a t i o n o f t h e o f f i c e r s by M r C h a p p l e . I n t h e c o u r s e o f t h i s

e v i d e n c e , e a c h o f f i c e r s t a t e d t h a t e a c h had l e a r n t o n l y on

2 8 J u l y	o f	t h e	f a c t t h a t M r C h h o t u	h a d	made	a	c o m p l a i n t	a g a i n s t
e a c h o f	them.	I f	I	a c c e p t	t h i s e v i d e n c e ,	i t mus t	f o l l o w	t h a t

t h e f a b r i c s u r r o u n d i n g M r ~ h h o t u ' s e v i d e n c e i s s u b s t a n t i a l l y

d e s t r o y e d a n d h i s	t o t a l c r e d i t p u t	i n t o j e o p a r d y .	I	h a v e	come
t o t h e c o n c l u s i o n	t h a t	t h e	c o m p l a i n a n t	h a s	l i t t l e c r e d i b i l i t y

a n d f a r t o o l i t t l e t o b e a c c e p t e d .

p e r h a p s	by	C o n s t a b l e	Gordon.	N e i t h e r	h e	n o r	C o n s t a b l e	S t a n t o n	n o r
S e r g e a n t	C h i r g w i n	n o t i c e d	t h a t	d a y	a n y	d e t a i n e e	who	a p p e a r e d	t o h a v e

b e e n	c r y i n g	o r who	e x h i b i t e d a	s w o l l e n	cheek .	D r S e l e c k i ,	c a l l e d
on	t h e m o r n i n g	o f	t h e	l a s t day	o f	t h e e v i d e n c e	saw M r C h h o t u

a b o u t 7 :00 p.m. o n 16 J u l y . The c o m p l a i n t s h e r e c e i v e d w e r e

d i f f e r e n t t o t h o s e made on t h e n e x t d a y t o D r B r a c k e n a n d w e r e

c o n f i n e d t o t h e zygoma a n d c l a v i c l e . He f o u n d s l i g h t s w e l l i n g

i n t h e a r e a o f t h e r i g h t zygoma a n d c o n c l u d e d t h a t t h i s may h a v e

b e e n	c a u s e d	e i t h e r by	i t b e i n g	i n f l i c t e d	o r s u s t a i n e d .	He	f o u n d
n o	g r a z e n o r	s i g n s o f	haemotoma.	Hav ing	r e a d	t h e r e l e v a n t	e v i d e n c e

a t p a g e s 8 , 54 a n d 6 5 , h e c o n c l u d e d on t h e b a s i s o f t h a t e v i d e n c e

t h a t h e w o u l d h a v e e x p e c t e d more damage t h a n h e f o u n d . I t i s n o t e d

t h a t h e r e c e i v e d no c o m p l a i n t o f p a i n i n t h e o c c i p i t a l a r e a o r i n

t h e s t o m a c h .

M r C h a p p l e was mos t p e r s u a s i v e i n s u b m i t t i n g t h a t I

s h o u l d	d i f f e r e n t i a t e M r D i c k i e ' s	o b s e r v a t i o n s made	h a l f	t o o n e
h o u r	l a t e r a f t e r t h e a l l e g e d	a s s a u l t and	t h o s e o f	D r S e l e c k i a t

a b o u t 7 :00 p.m. o n t h e 1 6 t h , w h i c h m i g h t b e t h o u g h t t o b e s i m i l a r

t o t h e o b s e r v a t i o n s o f C o n s t a b l e P e n d l e b u r y a b o u t 7:45 on t h a t
