The applicant seeks special leave to appeal against the decision of the Court of Appeal of the Supreme Court of New South Wales (Bell P, Macfarlan JA agreeing, Wright J dissenting) dismissing the applicant's application for judicial review of a decision of the Full Bench of the Industrial Relations Commission of New South Wales ("IRC") which dismissed the applicant's appeal against a decision of the IRC which upheld the respondent's application for review in relation to unfair dismissal and ordered that the respondent be reinstated to the New South Wales police force.
None of the applicant's proposed grounds of appeal enjoy sufficient prospects of success to warrant the grant of special leave to appeal. The applicant requires an extension of time, but, in the circumstances, it would be futile to grant the extension which is sought.
Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application with costs.
