GLEESON CJ:   This appeal was heard in Perth on 25 and 26 August 2004 by a Court constituted by Justices McHugh, Gummow, Hayne, Callinan and myself.  On 20 May 2005 the Court made orders disposing of the appeal.  We now vary those orders to reflect the undertakings given at the time of the grant of special leave to appeal.  The amended orders of the Court are:

  1. Appeal allowed;

  1. Appellant to pay the costs of the respondent of the appeal;

  1. Set aside orders 1 to 4 of the Full Court of the Supreme Court of Western Australia made on 20 November 2002 and in their place order that the appeal to that Court be dismissed.

I publish those orders.
