COMMERCIAL VESSELS ACT 1979—REGULATION
(Relating to fees in connection with vessel permits)

HIS Excellency the Governor, with the advice of the Executive Council,
and in pursuance of the Commercial Vessels Act 1979, has been pleased to approve the Regulation made by the Maritime Services Board of New South Wales and set forth hereunder.

The Maritime Services Board of New South Wales, in pursuance of the
Commercial Vessels Act 1979, hereby makes the following Regulation:
Commencement
l. This Regulation commences on 30 June 1995.
Amendment
2. The Commercial Vessels (Permits) Regulation 1986 is amended by
omitting items 1, 2 and 3 from Schedule 3 and by inserting instead the
following items:
1. Fees etc in respect of an application
for a vessel permit and investigation of
the application (section 17):
1995—No. 258
1.1 For a survey carried out in
connection with an applicationfor a permit (including
examination, approval of plans,
witnessing position of draught
marks, witnessing of inclining
test and except as provided by
items 1.3, 1.4 and 1.5):Class 1, 2 and 4 permit $90 per metre
(vessel 7.5 metres in length length and over)
Class 1, 2 and 4 permit $45 per metre
(vessel less than 7.5 metres length in length)
Class 3 permit (vessel 15 $74 per metre
metres in length and over) length
Class 3 permit (vessel less $29 per metre
than 15 metres in length) length
(NOTE: Where information is
required to be submitted more
than once for examination in
connection with approval ofplans, the fee payable for each subsequent examination is $90 per hour or part of an hour to
so examine and approve.)
1.2 For examination and approval of $90 per hour or stability data
part of an hour to so examine and approve
1.3 For a survey or inspection The fee or carried out in connection with charge authorised an application for a permit of under section 20 vessel changing from a (3) of the Act temporary permit (section 20) 1995—No. 258
1.4 Where permit is additional or
substitute permit (except as
provided by item 1.5):
1.4.1 For examination, approval $90 per hour or of plans, witnessing part of an hour position of draught marks, to so examine, witnessing of inclining approve and tests and approval of witness stability data 1.4.2 To inspect alterations, $90 per hour or additions or other such part of an hour matters and to sight to so inspect and equipment only (not sight payable if carried out in
conjunction with item
1.4.1)
1.5 Where the vessel has been or is $90 per hour or
to be issued with a classification part of an hour certificate in respect of its hull to so examine, and machinery by a witness and Classification Society within the approve meaning of the Code—for a survey carried out in connection with an application for a permit including examination and
approval of plans or other
matter referred to in item 1 .l or1.2
1.6 Where plans are submitted in $90 per hour or connection with an application part of an hour for an additional class or for to so examine modification to a vessel already and approve the subject of a permit—for
examination and approval ofplans
2. Fees etc in respect of a survey carried

schedule or direction of the Board

EXPLANATORY NOTE
The object of this Regulation is to increase fees payable to the Maritime Services
Board as set out in the Commercial Vessels (Permits) Regulation 1986 in respect of
(a) an application for a vessel permit and investigation of such an application; and
(b) a survey of a vessel carried out in accordance with a survey schedule or direction of the Board; and
(c) the issue of a temporary permit for a vessel.
This Regulation is made under the Commercial Vessels Act 1979, including section 52 (the general regulation-making power, in particular, section 52 (1) (a) and (b)) and
the sections referred to in the various items being inserted by this Regulation.
