COMMERCIAL VESSELS ACT 1979 - REGULATION

(Relating to fees in connection with vessel permits)

HIS Excellency the Governor, with the advice of the Executive

Council, and in pursuance of the Commercial Vessels Act 1979, has been pleased to approve the Regulation made by the Maritime Services Board of New South Wales and set forth hereunder.

The Maritime Services Board of New South Wales, in pursuance of the Commercial Vessels Act 1979, hereby makes the following Regulation:

Commencement

1. This Regulation commences on 10 August 1990.

Amendments

2. The Commercial Vessels (Permits) Regulation 1986 is amended:

(a)

by omitting items 1, 2 and 3 from Schedule 3 and by inserting instead the following items:

1.     Fees etc. in respect of application for a vessel permit and investigation of the application (section 17):

1.1 For a survey carried out in
connection with an
application for a permit
(including examination,
approval of plans,
witnessing position of

draught marks, witnessing of inclining test and except as provided by items 1.3, 1.4 and 1.5):

Class 1, 2 and 4 permit (vessel 7.5 metres in length and over)

$80 per metre length

Class 1, 2 and 4 permit (vessel less than 7.5 metres in length)

$40 per metre length

Class 3 permit (vessel 15 metres in length and over)

$65 per metre length

Class 3 permit (vessel less
than 15 metres in $25 per metre length
length)
(NOTE:  Where

information is required to be submitted more than once for examination in connection with approval of plans, the fee payable for

each subsequent

examination is $80 per hour or part of an hour to so examine and approve.)

1.2 For examination and

approval of stability data

$80 per hour or part of an hour to so examine and approve

1.3

For a survey or inspection carried out in connection with an application for a permit of vessel changing from a temporary permit The fee or charge

(section 20) authorised under section 20 (3) of the Act

1.4

Where permit is additional or substitute permit (except as provided by item 1.5):

1.4.1 For examination,
approval of plans,

witnessing position of

draught marks,
witnessing of $80 per hour or part
inclining tests and of an hour to so

approval of stability witness and approve

data

1.4.2 To inspect alterations,

additions or other

such matters and to sight equipment only

(not payable if $80 per hour or part
carried out in of an hour to so

conjunction with item inspect
1.4.1)

1.5

Where the vessel has been or is to be issued with a classification certificate in respect of its hull and

machinery by a

Classification Society within the meaning of the Code - For a survey carried out in

connection with an
application for a permit
including examination and
approval of plans or other $80 per hour or part
matter referred to in item of an hour to so
1.1 or 1.2 examine, witness and
approve
1.6 Where plans are submitted in connection with an application for an additional class or for modification to a vessel already the subject of a permit - Examination and approval of plans $80 per hour or part
of an hour

2.      Fees etc. in respect of a survey carried out in accordance with a survey schedule or direction of the Board (section 30) (except as provided by item 1.5):

Class 1 permit $30 per metre length
Class 2 permit $25 per metre length
Class 3 permit $19 per metre length
Class 4 permit

(vessel 6 metres in length

or over) $30 per metre length

Class 4 permit

(vessel less than 6 metres

in length) $19 per metre length

3.     Fee for issue of a temporary permit (section 19 (4)):

3.1 no inspection required $40
3.2 inspection required $90 per visit
(b) by omitting the note from item 10 of Schedule 3 and by inserting instead the following matter:

(NOTE: If an application is made for the vessel the fee is to be deducted from the fee otherwise payable under item 1.1)

EXPLANATORY NOTE

The object of this Regulation is to amend the Commercial Vessels (Permits)

Regulation 1986 so as to increase fees:

(a) in respect of an application for a vessel permit and investigation of such an application; and
(b) in respect of a survey of a vessel carried out in accordance with a survey schedule or direction of the Maritime Services Board; and
(c) in respect of the issue of a temporary permit for a vessel.
