Amendment (Fees) Regulation 2000

Commercial Vessels Act 1979

His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Commercial Vessels Act 1979.

Explanatory note
The object of this Regulation is to increase certain fees and charges prescribed by the Commercial Vessels (Permits) Regulation 1986 for:

(a) applications for permits under the Commercial Vessels Act 1979, and
(b) investigations of those applications, and
(c) surveys of vessels undertaken in accordance with the Act, and

(d) miscellaneous other matters. Intergovernmental Agreement Implementation (GST) Act 2000 (which, as a transitional measure, allows fees determined by or in accordance with an Act or statutory rule to be increased to account for any GST payable on the supply of the service to which the fee relates) is no longer to apply to these fees and charges. This Regulation is made under the Commercial Vessels Act 1979, including sections 17 and 52 (the general regulation-making power).

This fee and charge increase takes account of an annual increase in the Consumer
Price Index and, where applicable, amounts of GST that are now payable for the
supply of certain services.

1     Name of Regulation

This Regulation is the Commercial Vessels (Permits) Amendment

(Fees) Regulation 2000.

2 Commencement

This Regulation commences on 1 October 2000.

3 Amendment of Commercial Vessels (Permits) Regulation 1986

The Commercial Vessels (Permits) Regulation 1986 is amended as set out in Schedule 1.

The explanatory note does not form part of this Regulation.

Insert after clause 14 (3):

(4) Section 6 of the Intergovernmental Agreement Implementation (GST) Act 2000 does not apply to a fee, charge or expense set out in Schedule 3.

For a vessel more than 7.5 metres but less than or $216 per metre (or
equal to 20 metres in length part of a metre) of length of the vessel
For a vessel subject to a Class 1 permit that is more $238 per metre (or
than 20 metres in length part of a metre) of length of the vessel
For a vessel, other than one subject to a Class 1 $216 per metre (or
permit, that is more than 20 metres in length part of a metre) of length of the vessel

4           Work carried out in connection with an application for a permit in respect of a vessel of a design or production run for which a prototype approval has previously been issued:

For a vessel less than or equal to 7.5 metres in $57 per metre (or
length part of a metre) of length of the vessel
For a vessel more than 7.5 metres but less than or $108 per metre (or
equal to 20 metres in length part of a metre) of length of the vessel
For a vessel subject to a Class 1 permit that is more $108 per metre (or
than 20 metres in length part of a metre) of length of the vessel
For a vessel, other than one subject to a Class 1 $108 per metre (or
permit, that is more than 20 metres in length part of a metre) of length of the vessel

Work associated with the repeated re-examination of $108 per hour or
vessel survey plans part of an hour

Investigation as to whether the suspension of a $108

permit was justified (section 22 (5)):
