Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Commercial Agents and Private Inquiry Agents Act 1963.

Explanatory note

The object of this Regulation is to enable registered training organisations other than the including section 10 (6) (a) (iii) and section 44 (the general regulation-making power).

TAFE Commission to provide commercial and private inquiry agency qualifications.

1      Name of Regulation

This Regulation is the Commercial Agents and Private Inquiry Agents
Amendment (Qualifications) Regulation 2005.

2 Amendment of Commercial Agents and Private Inquiry Agents Regulation 2000

The Commercial Agents and Private Inquiry Agents Regulation 2000 is amended as set out in Schedule 1.

Schedule 1 Amendments

(Clause 2)

[1]      Clause 10 Prescribed experience and qualifications

Omit clause 10 (1) (b). Insert instead:

(b) the prescribed qualification is a certificate (or other similar qualification) in commercial agency practice issued by the TAFE Commission or a registered training organisation approved by the Commissioner of Police.

[2]      Clause 10 (2) (b)

Omit the paragraph. Insert instead:

(b) the prescribed qualification is a certificate (or other similar qualification) in private agency practice issued by the TAFE Commission or a registered training organisation approved by the Commissioner of Police.

[3]      Clause 10 (3)

Insert after clause 10 (2):

(3)

In this clause, registered training organisation means an education or training provider registered under the Vocational Education and Training Accreditation Act 1990.
