Made by the Governor in Executive Council.

Part 1 — Preliminary

1.             Citation

These regulations are the Commerce Regulations Amendment
(Motor Vehicle Dealers and Repairers) Regulations 2022.

2.             Commencement

These regulations come into operation as follows —

(a) Part 1 — on the day on which these regulations are

published in the Gazette (gazettal day);

(b)	Part 2 — on 1 March 2023;
(c)	the rest of the regulations — on the day after gazettal

day.

Part 2 — Motor Vehicle Dealers (Licensing)

Regulations 1974 amended

3.             Regulations amended

This Part amends the Motor Vehicle Dealers (Licensing)
Regulations 1974.

4.             Regulation 11 inserted

After regulation 10 insert:

11.           Transitional provision for Commerce Regulations

Amendment (Motor Vehicle Dealers and Repairers)
Regulations 2022

(1)	A dealer’s licence that is in force immediately before
1 March 2023 continues to have effect, on and after that day, as if the Commerce Regulations Amendment
(Motor Vehicle Dealers and Repairers) Regulations
2022 regulation 6 had not come into operation.
(2)	Subregulation (1) ceases to operate in relation to a
dealer’s licence on the day on which —

(a) the licence expires; or

(b) if the licence is renewed — the licence would

have expired had it not been renewed.

5.             Schedule 4 heading amended

In the heading to Schedule 4 delete “Classes and

descriptions” and insert:

6.             Schedule 4 amended

In Schedule 4 delete:

Part 3 — Motor Vehicle Repairers Regulations 2007

7.             Regulations amended

This Part amends the Motor Vehicle Repairers
Regulations 2007.

8.             Regulation 3 amended

(1)	In regulation 3(1) delete the definition of driveline and transmission work.
(2)	In regulation 3(1) insert in alphabetical order:

AUR means release 1.0, 1.1, 2.0, 2.1, 3.0, 4.0, 5.0, 6.0,

6.1, 7.0 or 7.1 of the training package AUR entitled

Automotive Retail, Service and Repair Training

Package, published by PwC’s Skills for Australia;

AUR05 means release 1.0, 2.0, 2.1, 2.2, 2.3, 2.4, 3.0

or 4.0 of the training package AUR05 entitled

Automotive Industry Training Package Retail, Service

and Repair or Automotive Industry Retail, Service and
Repair Training Package, published by Auto Skills

Australia Ltd;

AUR12 means release 1.0, 1.1, 2.0 or 2.1 of the
training package AUR12 entitled Automotive Industry
Retail, Service and Repair Training Package,

published by Auto Skills Australia Ltd;

AUR99 means release 1, 2, 3 or 4 of the training

package AUR99 entitled Automotive Industry National

Training Package — Retail, Service and Repair Sector,

published by Australian Training Products Ltd;

specialisation means a specialisation, or descriptor, provided for in AUR05 in relation to a qualification under AUR05;

wheel aligning, steering and suspension work means

any work required to do any of the following in respect

of a motor vehicle —

(a)	to inspect, service or replace the steering system or suspension system;
(b)	to balance a wheel or align the wheels.

(3)	In regulation 3(1) in the definition of vintage vehicle delete
“Part 2.” and insert:
Part 2;

9.             Regulation 5 replaced

Delete regulation 5 and insert:

5.             Repair work prescribed and classified (Act s. 5)

Each kind of work listed in the Table is prescribed to

be —

(a)	repair work for the purposes of the Act; and
(b)	a class of repair work for the purposes of Part 3 of the Act.

At the end of Part 2 insert:

8A.	Examinations prescribed for wheel aligning, steering and suspension work (Act s. 42(2)(a)(ii))
For the purposes of section 42(2)(a)(ii) of the Act, a person is sufficiently qualified to carry out wheel aligning, steering and suspension work if the person has passed the examinations required to complete the
following units of competency under AUR —

(a)	AURAEA002 — Follow environmental and
sustainability best practice in an automotive workplace;
(b)	AURASA102 — Follow safe working practices

in an automotive workplace;

(c) AURATA001 — Identify basic automotive

faults using troubleshooting processes;

(d) AURTTD002 — Inspect and service steering

systems;

(e) AURTTD004 — Inspect and service

suspension systems;

(f) AURTTJ011 — Balance wheels and tyres;

(g) either —

(i)      AURHTD104 — Carry out heavy

vehicle wheel alignment operations; or

(ii)      AURLTD106 — Carry out light vehicle

wheel alignment operations.

Regulations 2022

(1)	In this regulation —
commencement day means the day on which the
Commerce Regulations Amendment (Motor Vehicle
Dealers and Repairers) Regulations 2022 Part 3 comes into operation.
(2)	Despite the amendments made to these regulations by the Commerce Regulations Amendment (Motor Vehicle Dealers and Repairers) Regulations 2022 Part 3, a
repairer’s certificate that is in force immediately before
commencement day continues to have effect, on and after commencement day, in relation to the same class or classes of repair work as it did before commencement day.
(3)	The amendments made by the Commerce Regulations
Amendment (Motor Vehicle Dealers and Repairers)
Regulations 2022 Part 3 do not limit the operation of regulation 16(5).
