REGULATIONS UNDER THE CUSTOMS ACT 1901-1936 AND THE COMMERCE (TRADE DESCRIPTIONS) ACT 1905-1933.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Customs Act 1901-1936 and the Commerce (Trade Descriptions) Act 1905-1933.

Amendments of the Commerce (General Exports) Regulations.

Interpretation.

1. In these Regulations, any reference to a regulation or Schedule shall be read as a reference to a regulation contained in, or a Schedule to, the Commerce (General Exports) Regulations, as amended to the date of commencement of these Regulations.

Cases for fresh fruit.

2. Regulation 47 is amended—

(a) by omitting the table contained in paragraph (a) and inserting in its stead the following table:—

(b) by inserting after paragraph (d) the following paragraph:—

“(da) Pears intended for export shall be packed only in the type of case described as ‘Pear’, ‘Long bushel’ or ‘Tray’ in the table contained in paragraph (a) of this regulation:

Provided that pears intended for export to any Eastern port may be packed in the type of case described as ‘Standard bushel’ in that table;”

Grade standards for apples and pears.

3. Regulation 48 is amended—

(a) by inserting before paragraph (a) of sub-regulation (2.) the following paragraph:—

“(aa) The pears shall be of the varieties specified in the Fourth Schedule to these Regulations:

Provided that the Secretary may permit, for experimental purposes only, the exportation of pears other than those specified in the Schedule;

(b) by inserting after the word “case” (second occurring) in paragraph (b) of sub-regulation (2.) the words “, and the total area covered by such blemishes on any pear shall not exceed the area contained in a circle having a diameter of one quarter of an inch”; and

(c) by inserting at the end thereof the following paragraph:—

“(e) In the case of pears of the following varieties, namely:—

Beurre D’Anjou;

Doyenne de Comice;

Josephine;

Packhams Triumph;

Williams Bon Chretien; and

Howell,

russetting shall not be considered a blemish provided that not more than 15 per centum of the surface of any pear in the case of pears of the ‘Extra Fancy’ variety and 30 per centum of the surface of any pear in the case of pears of ‘Fancy’ variety is affected”.

Grade standards for plums.

4. Regulation 48b is amended by omitting from paragraph (b) the words “, and the plums shall be wrapped in paper of a quality approved by the Secretary”.

Additional trade description for apples and pears.

5. Regulation 61 is amended—

(a) by omitting the word “and” (last occurring); and

(b) by adding at the end thereof the following words and figures “‘3½ inches’, which term shall include fruit of 3½ inches or greater diameter; and”.

Export permits.

6. Regulation 81 is amended by omitting the words “the examining” and inserting in their stead the word “an”.

Certificates may be issued for approved exports.

7. Regulation 91 is amended by omitting from sub-regulation (1) the words “The officer, after inspecting and examining any goods for

 

export enumerated in these Regulations,” and inserting in their stead the words “Where any goods specified in these Regulations which are intended for export have been inspected and examined, an officer”.

Certificates not to be issued and goods not to be stamped in certain cases.

8. Regulation 93 is amended by omitting the word “The” (first occurring) and inserting in its stead the word “An”.

Second Schedule.

9. The Second Schedule is amended—

(a) by omitting from Form 4 the words “Department of Trade and Customs”;

(b) by omitting from that Form the words “Examining Officer” and inserting in their stead the words “Officer of the Department of Commerce”;

(c) by omitting from that Form the words “............................................ Appointed place.”;

(d) by omitting Form 6 and inserting in its stead the following Form:—

This is to certify that, upon examination of cases selected at random, the fresh Apples and/or Pears described hereunder have been found to be in a sound shipping condition, and packed and graded in accordance with the provisions of the Commerce (General Exports) Regulations.

(e) by omitting from Forms 7 to 11 (inclusive) the words “Department of Trade and Commerce”; and

(f) by omitting from those Forms the words “Examining Officer” and inserting in their stead the words “Officer of the Department of Commerce”.

 

Third Schedule.

10. The Third Schedule is repealed and the following Schedule inserted in its stead:—
