Commencement Proclamation
under the
Fair Trading Legislation Amendment (Reform) Act 2018 No 65
MARGARET BEAZLEY, Governor
I, the Honourable Margaret Beazley AO QC, Governor of New South Wales, with the advice of the Executive Council, and in pursuance of section 2(2) of the Fair Trading Legislation
Amendment (Reform) Act 2018, do, by this my Proclamation, appoint 1 February 2020 as the day
on which the following provisions of that Act commence—
| (a) | Schedules 3, 4.3 and 8, |
| (b) | the uncommenced provisions of Schedule 4.4. |

| Explanatory note | ||
| The object of this Proclamation is to commence certain provisions of the Fair Trading Legislation | ||
| Amendment (Reform) Act 2018 that— | ||
|
and Second-hand Dealers Act 1996, Property, Stock and Business Agents Act 2002 and Retirement Villages Act 1999 primarily relating to the eligibility of businesses in external administration to hold
certain licences under those Acts, and
| (b) | amend the Motor Dealers and Repairers Act 2013 and Motor Dealers and Repairers Regulation |
2014 in relation to specialised authorities (being a type of tradesperson’s certificate) and notification
| and other requirements relating to the premises at which a licence holder carries on a business authorised by the licence, and | |
| (c) | provide for forms that are authorised or required under certain Acts to be given in the form approved by the relevant Secretary instead of prescribed by regulations under those Acts. |
