Commencement Proclamation

under the

Mental Health (Forensic Provisions) Amendment (Victims) Act 2018 No 85

DAVID HURLEY, Governor

I, General The Honourable David Hurley AC DSC (Ret’d), Governor of New South Wales, with the advice of the Executive Council, and in pursuance of section 2 (2) of the Mental Health

(Forensic Provisions) Amendment (Victims) Act 2018, do, by this my Proclamation, appoint:

(a) 7 January 2019 as the day on which the following provisions commence:
(i) Schedule 1 [1], to the extent that it inserts the definitions of Commissioner of

Victims Rights, registered victim and Victims Register,

(ii)      Schedule 1 [14] (except to the extent it inserts the heading to Part 5A and section 76L),

(iii)      Schedule 4, and

(b) 4 February 2019 as the day on which Schedule 1 [8] and [10] commence.

Explanatory note

The object of this Proclamation is to commence amendments relating to the rights of victims in proceedings involving offenders who are forensic patients before the Mental Health Review Tribunal, the establishment of a Victims Register of victims of forensic patients and notifications to victims of related matters.
