under the

Local Government Amendment (Governance and Planning) Act 2016

No 38

I, General The Honourable David Hurley AC DSC (Ret’d), Governor of New South Wales, with the advice of the Executive Council, and in pursuance of section 2 (1) of the Local Government

Amendment (Governance and Planning) Act 2016, do, by this my Proclamation, appoint
14 December 2018 as the day on which Schedule 1 [18], [25], [26], [28]–[30], [50]–[74], [78],

[79], [86], [87], [90] and [91] to that Act commence.

Explanatory note
The object of this Proclamation is to commence amendments to the Local Government Act 1993 that:
(a) provide for a model code of practice for meetings, and

(b)

provide for misconduct by councillors relating to disclosures of pecuniary interests to be dealt with in the same way as other misconduct, by including disclosure requirements in mandatory code of conduct provisions and applying the same disciplinary provisions that apply to breaches of the code, and

(c)

apply the model code provisions relating to disclosure of pecuniary interests to members of council committees and other advisers.
