Commencement Proclamation

under the

Workers Compensation Legislation Amendment Act 2018 No 62

DAVID HURLEY, Governor

I, General The Honourable David Hurley AC DSC (Ret’d), Governor of New South Wales, with the advice of the Executive Council, and in pursuance of section 2 (1) of the Workers

Compensation Legislation Amendment Act 2018, do, by this my Proclamation, appoint 1 January

2019 as the day on which the following provisions of that Act commence:

(a) Schedule 1.1, 1.2 and 1.3 [5]–[8],
(b) Schedule 2,
(c) Schedule 4 [1] and [2] (to the extent that it inserts section 40D into the Workplace Injury

Management and Workers Compensation Act 1998),

(d) Schedule 7.2 and 7.3.

Explanatory note

(d) prohibiting commutation to a lump sum of a liability to pay medical expenses compensation in respect of catastrophic injury, and
(e) notification by employers of information relating to procedural matters under those Acts.

Explanatory note
The object of this Proclamation is to commence certain uncommenced provisions of the Workers
Compensation Legislation Amendment Act 2018, which include amendments to the Workers Compensation Act 1987, the Workplace Injury Management and Workers Compensation Act 1998 and a Regulation under
those Acts relating to:
(a) dispute resolution processes in connection with work capacity decisions, and
(b) determination by the Workers Compensation Commission of medical disputes concerning permanent impairment, and
(c) mandatory notification of offences under those Acts, and
