Commencement Proclamation

under the

Road Transport Legislation Miscellaneous Amendments Act 2018 No 23

I, General The Honourable David Hurley AC DSC (Ret’d), Governor of New South Wales, with the advice of the Executive Council, and in pursuance of section 2 (2) of the Road Transport Legislation Miscellaneous Amendments Act 2018, do, by this my Proclamation, appoint 1 October 2018 as the day on which Schedule 1.1 [1], [3] and [4] to that Act commence.

Explanatory note
The object of this Proclamation is to commence amendments to the Heavy Vehicle (Adoption of National
Law) Act 2013 that are consequential on changes in the Heavy Vehicle National Law. Those amendments:
(a) omit a reference to a repealed provision in a section about the payment of the regulatory component of heavy vehicle registration charges into the National Heavy Vehicle Regulator Fund, and
(b) omit a section about the availability of the defence of mistake of fact, which is now redundant, and
(c) omit a reference to repealed provisions in a section about the availability of alternative orders for a person found guilty of an applicable heavy vehicle offence.
