Commencement Proclamation

under the

Companion Animals and Other Legislation Amendment Act 2018 No 27

I, General The Honourable David Hurley AC DSC (Ret’d), Governor of New South Wales, with the advice of the Executive Council, and in pursuance of section 2 of the Companion Animals and

Other Legislation Amendment Act 2018, do, by this my Proclamation, appoint 1 July 2018 as the

day on which Schedules 1 [12] and [13] and 2 [3] and [8]–[11] to that Act commence.

Explanatory note
The object of this Proclamation is to commence the following:
(a) amendments to the Companion Animals Act 1998 that increase the maximum penalty for the offences of denying entry to an assistance animal or unlawfully imposing a charge for entry of an assistance animal,
(b) amendments to the Prevention of Cruelty to Animals Act 1979 that:

(i)         update the name of a Department, and

(ii)       extend the power of courts hearing criminal proceedings for animal cruelty offences, and certain other offences, to make orders requiring the accused person to reimburse certain costs, and

(iii)      authorise courts to disqualify persons convicted of animal cruelty offences from keeping, or participating in keeping, animals in the future, and

(iv)       extend the operation of those amendments to criminal proceedings that are underway.
