Commencement Proclamation

under the

Health Legislation Amendment Act 2018 No 2

I, General The Honourable David Hurley AC DSC (Ret’d), Governor of New South Wales, with the advice of the Executive Council, and in pursuance of section 2 (2) of the Health Legislation

Amendment Act 2018, do, by this my Proclamation, appoint 1 July 2018 as the day on which

Schedules 4 and 5 to that Act commence.

Explanatory note
The object of this Proclamation is to commence certain provisions of the Health Legislation Amendment
Act 2018 that amend:
(a) the Mental Health Act 2007 to enable the Mental Health Review Tribunal to hear reviews and electro convulsive therapy inquiries in the absence of a patient or person in certain circumstances if the patient or person refuses to attend or is too unwell to attend, and
(b) the Mental Health (Forensic Provisions) Act 1990 to require regular reviews by the Mental Health Review Tribunal of persons (other than forensic patients) who are subject to community treatment orders and who are detained in correctional centres and to provide for the apprehension of forensic patients and correctional patients who breach conditions of leave from mental health facilities.
