I, General The Honourable David Hurley AC DSC (Ret’d), Governor of New South Wales, with the advice of the Executive Council, and in pursuance of section 2 of the Waste Avoidance and

Resource Recovery Amendment (Container Deposit Scheme) Act 2016, do, by this my

Proclamation, appoint 1 December 2019 as the day on which Schedule 1 [3] to that Act, to the extent that it inserts section 39 into the Waste Avoidance and Resource Recovery Act 2001, commences.

Explanatory note
The object of this Proclamation is to commence, on 1 December 2019, the remaining amendment made by the Waste Avoidance and Resource Recovery Amendment (Container Deposit Scheme) Act 2016. The amendment inserts a provision into Part 5 of the Waste Avoidance and Resource Recovery Act 2001 that prohibits the supply of beverages in containers not bearing refund markings complying with the requirements of regulations made under that Part.
