Commencement Proclamation

under the

Waste Avoidance and Resource Recovery Amendment (Container Deposit

Scheme) Act 2016 No 57

I, the Honourable Justice Margaret Beazley AO, Administrator of New South Wales, with the advice of the Executive Council, and in pursuance of section 2 of the Waste Avoidance and

Resource Recovery Amendment (Container Deposit Scheme) Act 2016, do, by this my

Proclamation, appoint:

(a)	1 November 2017 as the day on which Schedule 1 [3] to that Act, to the extent that it inserts the heading to Subdivision 1 of Division 3 of Part 5 and sections 37 and 38 (other than section 38 (1) (b)) into the Waste Avoidance and Resource Recovery Act 2001, commences, and
(b)	1 December 2017 as the day on which Schedule 1 [3] to the Waste Avoidance and Resource

Recovery Amendment (Container Deposit Scheme) Act 2016, to the extent that it inserts

section 38 (1) (b) and Subdivision 2 of Division 3 of Part 5 into the Waste Avoidance and

Resource Recovery Act 2001, commences.

Explanatory note

The object of this Proclamation is to commence the remaining provisions of the Waste Avoidance and

Resource Recovery Amendment (Container Deposit Scheme) Act 2016, except to the extent that it inserts

section 39 (which prohibits the supply of beverages in containers without refund markings complying with
the requirements of regulations) into the Waste Avoidance and Resource Recovery Act 2001.
