under the

Criminal Legislation Amendment (Organised Crime and Public Safety) Act

2016 No 16

I, General The Honourable David Hurley AC DSC (Ret’d), Governor of New South Wales, with the advice of the Executive Council, and in pursuance of section 2 of the Criminal Legislation Amendment (Organised Crime and Public Safety) Act 2016, do, by this my Proclamation, appoint 8 September 2016 as the day on which Schedules 1, 2 and 4 [1] and [3] to that Act commence.

Explanatory note
The object of this Proclamation is to commence:
(a) amendments to the Confiscation of Proceeds of Crime Act 1989 relating to the forfeiture of property in substitution for property that is used in connection with a serious criminal offence but is not available for forfeiture, and
(b) amendments to the Crimes Act 1900 relating to the indictable offence of dealing with property suspected of being proceeds of crime, and
(c) amendments to the Criminal Procedure Act 1986 relating to the summary prosecution of that indictable offence.
