Commencement Proclamation

under the

Law Enforcement (Powers and Responsibilities) Amendment Act 2014

I, General The Honourable David Hurley AC DSC (Ret’d), Governor of New South Wales, with the advice of the Executive Council, and in pursuance of section 2 of the Law Enforcement (Powers and Responsibilities) Amendment Act 2014, do, by this my Proclamation, appoint 1 September 2016 as the day on which the uncommenced provisions of that Act commence.

Explanatory note
The object of this Proclamation is to commence the uncommenced provisions of the Law Enforcement
(Powers and Responsibilities) Amendment Act 2014, including:
(a) amendments to the Law Enforcement (Powers and Responsibilities) Act 2002 relating to:

(i)         investigations and questioning of persons (including persons who are accompanying police officers for the purpose of an investigative procedure where the person is free to leave even though the person is a suspect), and

(ii)       personal searches (including strip searches), and

(iii)      crime scene powers, and

(iv)       other miscellaneous matters in respect of the administration of the Act and the exercise of police powers, and

(b) consequential amendments of certain other legislation.
