Commencement Proclamation

under the

Associations Incorporation Amendment (Review) Act 2016 No 1

DAVID HURLEY, Governor

I, General The Honourable David Hurley AC DSC (Ret’d), Governor of New South Wales, with the advice of the Executive Council, and in pursuance of section 2 of the Associations Incorporation Amendment (Review) Act 2016, do, by this my Proclamation, appoint:

(a)

15 April 2016 as the day on which Schedule 1 [1], [6], [7], [10], [11], [13], [16], [17], [20]–[23], [25]–[28], [32] and [34] to that Act commence, and

(b) 1 September 2016 as the day on which the uncommenced provisions of that Act commence.

Explanatory note

(d) update the name of a Department and the title of the head of that Department, and
(e) make consequential and minor clarifying amendments to the Associations Incorporation Act 2009.
Explanatory note
The object of this Proclamation is to commence on 1 September 2016 the Associations Incorporation
Amendment (Review) Act 2016, except for certain provisions, to commence on 15 April 2016, that:
(a) enable the Secretary under the Associations Incorporation Act 2009 to exercise certain additional functions with respect to an association (namely, changing an association’s name to its registration number, cancelling an association’s registration if satisfied it is in the public interest to do so and giving a certificate to wind up an association), and
(b) enable an investigator under the Fair Trading Act 1987 to exercise the functions of an authorised officer under the Associations Incorporation Act 2009, and
(c) extend the regulation-making power under the Associations Incorporation Act 2009 with respect to fees and allow savings and transitional regulations to be made on the enactment of any Act that amends that Act, and
