Commencement Proclamation

under the

Children (Education and Care Services National Law Application)
Act 2010 No 104

MARIE BASHIR, Governor I, Professor Marie Bashir AC, CVO, Governor of the State of New South Wales, with the advice of the Executive Council, and in pursuance of section 2 of the Children (Education and Care Services National Law Application) Act 2010, do, by this my Proclamation, appoint 1 January 2011 as the day on which the following provisions of that Act commence:

(a) Part 1,
(b) section 4, except to the extent that it applies the following provisions of the Education and Care Services National Law as a law of this jurisdiction:
(i) Parts 2–9,
(ii) section 229,
(iii) Part 12,
(iv) Divisions 1–5 of Part 13,
(v) sections 271–272,
(vi) sections 279, 280, 282, 285–288, 289 (3) and (4) and 290–292,
(vii) Divisions 5–7 of Part 14,

(viii)      Divisions 1 and 2 of Part 15,

(ix)      sections 322–323,

(x)      Schedule 2,

(c) section 5, except section 5 (1) (a), (b), (d) and 5 (2) (b),
(d) sections 6, 7, 9 and 16,
(e) Part 3.

Explanatory note

Explanatory note

The object of this Proclamation is to commence certain provisions of the Children (Education and Care Services National Law Application) Act 2010 so that part of the Education and Care Services National Law (as set out in the Schedule to the Education and Care Services National Law Act 2010 of Victoria) applies as a law of this jurisdiction. The provisions commenced confer functions on the Ministerial Council and establish the Australian Children’s Education and Care Quality Authority.
