Commencement Proclamation

under the

Courts and Crimes Legislation Amendment Act 2008 No 53

MARIE BASHIR, Governor I, Professor Marie Bashir AC, CVO, Governor of the State of New South Wales, with the advice of the Executive Council, and in pursuance of section 2 (2) of the Courts and Crimes Legislation Amendment Act 2008, do, by this my Proclamation, appoint 27 February 2009 as the day on which Schedules 1 and 22 to that Act commence.

Explanatory note

The object of this Proclamation is to commence Schedules 1 and 22 to the Courts and Crimes Legislation Amendment Act 2008. Schedule 1 amends the Births, Deaths and Marriages Registration Act 1995 and Schedule 22 amends the Births, Deaths and Marriages Registration Regulation 2006. The amendments relate to:

(a)

the legal recognition of persons who have undergone sex affirmation procedures and whose birth is not registered in New South Wales, and

(b)

the removal of redundant offences concerning the use of birth certificates by persons who have undergone sex affirmation procedures, and

(c) the process of registering a change of sex.
