Commencement Proclamation

under the

Environmental Planning and Assessment Amendment Act 2008
No 36

MARIE BASHIR, Governor I, Professor Marie Bashir AC, CVO, Governor of the State of New South Wales, with the advice of the Executive Council, and in pursuance of section 2 of the Environmental Planning and Assessment Amendment Act 2008, do, by this my Proclamation, appoint 26 October 2009 as the day on which the following provisions of that Act commence:

(a) Schedule 2.1 [21],
(b) Schedule 2.10 [10] and [11],
(c) Schedule 5.1 [1], [3], [4], [6], [8] and [11],
(d) Schedule 5.7.

Explanatory note

The object of this Proclamation is to commence certain provisions of the Environmental

Planning and Assessment Amendment Act 2008 that deal with the following:

(a)

reviewable conditions of development consents relating to extended hours of operation or increases in the maximum number of persons permitted in a building,

(b)

the types of development that may be the subject of a reviewable condition, the review procedures and the keeping of a register of development consents that are subject to such conditions,

(c)

miscellaneous amendments consequential on the revised regulation of entertainment venues (previously regulated as places of public entertainment).
