Explanatory note

(d)

provisions enabling appeals to the Local Court against a decision of the RTA to issue a notice of licence suspension or a notice of licence ineligibility,

(e) provisions making other miscellaneous amendments.

This Proclamation does not commence Schedule 2 [6] and [9]–[11] to the amending Act. Those provisions relate to the establishment of certain speeding offences as demerit point offences and are now unincorporable due to the operation of the Road Transport (Driver Licensing) Amendment (Speeding Offences) Regulation 2009. The appropriate incorporable amendments are to be made by Schedule 1 [2] and [4] to that Regulation (these amendments will commence on the commencement of Schedule 2 [8] to the amending Act, ie on 28 September 2009).
