Commencement Proclamation
under the
Road Transport (Driver Licensing) Amendment (Demerit Points
System) Act 2008 No 82
MARIE BASHIR, Governor I, Professor Marie Bashir AC, CVO, Governor of the State of New South Wales, with the advice of the Executive Council, and in pursuance of section 2 of the Road Transport (Driver Licensing) Amendment (Demerit Points System) Act 2008, do, by this my Proclamation, appoint 28 September 2009 as the day on which the uncommenced provisions of that Act (other than Schedule 2 [6] and [9]–[11]) commence.

| Explanatory note |
The object of this Proclamation is to commence the following provisions of the Road Transport (Driver Licensing) Amendment (Demerit Points System) Act 2008 (the amending Act):
| (a) | provisions applying the demerits point system to learner and provisional licence holders, |
| (b) | a provision dealing with the determination of demerit point thresholds for combined licences, |
| (c) | a provision dealing with the effect of the expiry of a driver licence during a suspension period, |

| (d) | provisions enabling appeals to the Local Court against a decision of the RTA to issue a notice of licence suspension or a notice of licence ineligibility, |
| (e) | provisions making other miscellaneous amendments. |
This Proclamation does not commence Schedule 2 [6] and [9]–[11] to the amending Act. Those provisions relate to the establishment of certain speeding offences as demerit point offences and are now unincorporable due to the operation of the Road Transport (Driver Licensing) Amendment (Speeding Offences) Regulation 2009. The appropriate incorporable amendments are to be made by Schedule 1 [2] and [4] to that Regulation (these amendments will commence on the commencement of Schedule 2 [8] to the amending Act, ie on 28 September 2009).
