Commencement Proclamation

under the

Fisheries Management and Planning Legislation Amendment
(Shark Meshing) Act 2008 No 86

MARIE BASHIR, Governor I, Professor Marie Bashir AC, CVO, Governor of the State of New South Wales, with the advice of the Executive Council, and in pursuance of section 2 (2) of the Fisheries Management and Planning Legislation Amendment (Shark Meshing) Act 2008, do, by this my Proclamation, appoint 31 August 2009 as the day on which Schedule 1 [4] to that Act commences.

Explanatory note

The object of this Proclamation is to commence Schedule 1 [4] to the Fisheries Management and Planning Legislation Amendment (Shark Meshing) Act 2008 which removes shark meshing from the list of designated fishing activities in Schedule 1A to the Fisheries Management Act 1994. The result will be to trigger the application of section 115RA of the Environmental Planning and Assessment Act 1979 to shark meshing (provided the necessary joint management agreement referred to in that section has been entered into) and consequently to disapply certain provisions of that Act to the shark meshing activities covered by the agreement.
