Commencement Proclamation

under the

Marine Safety Act 1998 No 121

JAMES JACOB SPIGELMAN, Lieutenant-Governor I, the Honourable James Jacob Spigelman AC, Lieutenant-Governor of the State of New South Wales, with the advice of the Executive Council, and in pursuance of section 2 of the Marine Safety Act 1998, do, by this my Proclamation, appoint 30 March 2009 as the day on which the following provisions of that Act commence:

(a)

Divisions 1–3 of Part 4 (other than sections 29 (b), (d), (f) and (g) and 36) and section 43,

(b) Divisions 2, 5 and 6 of Part 5 (other than sections 65 and 66),
(c) Division 2 of Part 8,

(d)

Schedule 2 to the extent that it repeals the Navigation Act 1901 (other than sections 1, 3, 4B, 133, 134, 141, 142, 144, 153 and 165A), Boating (Safety Equipment) Regulation—N.S.W., Water Traffic Regulations—N.S.W. and Navigation (Collision) Regulations 1983 and section 141 in its application to those repeals,

(e) clauses 2, 4 and 8 of Schedule 4.

Explanatory note
Explanatory note

The object of this Proclamation is to commence provisions of the Marine Safety Act 1998 dealing with the following matters:

(a) requirements for vessel registration,
(b) requirements for boat driving licences,
(c) general provisions relating to marine safety licences,
(d) regulation-making powers relating to safety equipment and facilities on vessels, design and construction of recreational vessels, the maximum number of passengers to be carried on vessels and the conduct of passengers on vessels,
(e) repeals of the provisions of the Navigation Act 1901 (with certain exceptions) and certain regulations,
(f) certain savings and transitional provisions.
