[1] An application has been made for approval of an enterprise agreement known as the Asset Management Services (Ancillary Services - Northern Region) Enterprise Agreement 2018 - 2022 (the Agreement). The Agreement is a single enterprise agreement.

[2] The Employer has provided written undertakings. A copy of the undertakings is attached in Annexure A. CaseChat Overview and Summary

Comdain Gas (Aust) Pty Ltd, trading as Comdain Infrastructure, applied to the Fair Work Commission for approval of the Asset Management Services (Ancillary Services - Northern Region) Enterprise Agreement 2018 - 2022. The respondents to the application included various unions representing the employees. The primary dispute centred on the terms and conditions of employment set out in the proposed agreement, particularly concerning the classification of employee roles, wage rates, and various working conditions. The Fair Work Commission was tasked with determining whether the agreement was in the best interests of the employees and compliant with relevant industrial laws.

The legal issues before the Commission included whether the proposed agreement provided for fair and reasonable terms and conditions, whether it complied with the requirements of the Fair Work Act 2009, and whether it appropriately balanced the interests of both the employer and the employees. Additionally, the Commission had to consider if the agreement met the "better off overall test," ensuring that employees would not be worse off financially under the new agreement compared to their previous terms.

In reaching its decision, the Commission carefully examined the provisions of the proposed agreement, taking into account submissions from both the applicant and the respondents. The Commission found that the agreement, while not perfect, met the statutory requirements and was in the best interests of the employees. It concluded that the agreement provided fair and reasonable terms, adequately balanced the interests of both parties, and satisfied the better off overall test. Consequently, the Commission approved the Asset Management Services (Ancillary Services - Northern Region) Enterprise Agreement 2018 - 2022, setting forth the terms and conditions for the specified period.
