GUMMOW J:   This special case was heard in Canberra on 29 and 30 August 2005 by the whole Court.  On 29 September 2005 the Court pronounced its orders in the matter and indicated that reasons for decision would be published later.  We now make that publication as follows.

The Chief Justice supports the orders made on 29 September and I publish his Honour’s reasons.  Justice McHugh is of contrary opinion and I publish his Honour’s reasons.  Justices Hayne, Callinan, Heydon and I support the orders made on 29 September and we publish our joint reasons.  Justice Kirby is of contrary opinion and I publish his Honour’s reasons.
