Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Combat Sports Act 2008.

Explanatory note
The object of this Regulation is to provide that any contest, display or exhibition of a combat sport where at least one of the contestants is or has been a registered combatant under the Combat Sports Act 2008 (the Act) is a professional combat sport contest for the purposes of the Act. This will mean that such a contest will be regulated as a professional combat sport contest whether or not the contest is for a monetary prize or other reward in money or money’s worth. Accordingly, it will be necessary for both contestants to be registered as combatants and for the contest to be conducted and promoted in accordance with the Act.
The Regulation also enables the Minister for Sport and Recreation to appoint officers of the Department of Education and Communities to monitor compliance with permits issued under Part 5 of the Act for amateur combat sport contests and wrestling contests held for public entertainment.
This Regulation is made under the Combat Sports Act 2008, including sections 3 (1) (definition of professional combat sport contest) and 73 (the general regulation-making power).

1 Name of Regulation
This Regulation is the Combat Sports Amendment Regulation 2011.
2 Commencement
(1) Except as provided by subclause (2), this Regulation commences on the
day on which it is published on the NSW legislation website.(2) Schedule 1 [1] commences on 28 October 2011.

Insert after clause 4:
4A Meaning of professional combat sport contest A contest, display or exhibition of a combat sport between persons is a professional combat sport contest for the purposes of section 3 (1) of the Act where at least one of the persons is or has been a registered combatant.

Insert after clause 54:
54A Compliance officers for amateur combat sport contests and
wrestling contests
(1) The Minister may appoint an officer of the Department or persons belonging to a class of officers of the Department as compliance officers for amateur combat sport contests and wrestling contests to which Part 5 of the Act applies. (2) For the purpose of monitoring compliance with the conditions of a permit issued in respect of such a contest, a compliance officer may do any of the following:
(a) attend the place at which the contest is being held or is scheduled to be held, (b) take photographs, film and audio, video and other recordings at the place, (c) ask questions of the promoter, the contestants and any other person involved in the contest, (d) inspect, make copies of, or take extracts from, any records or documents relating to the contest. (3) A compliance officer may report to the Minister on compliance with the conditions of a permit issued in respect of an amateur combat sport contest or a wrestling contest.
