AN ACT to amend " The Colonial Passengers' Ordinance,

1861."

[Assented to, 21st December, 1875.]

EREAS by " The Colonial Passengers' Ordinance, 1861," Preamble.

it is provided amongst other things that every Colonial ship or vessel shall be commanded by a competent master for her intended voyage ; and by "The Colonial Passengers' Amendment Ordinance, 1868," provision is made for securing or testing the competency of masters of such vessels; and whereas it is expedient that such ships should also carry a competent mate, and that the provisions of the last recited Ordinance should be made applicable for securing or testing the competency of persons to be employed as mates; and whereas it is expedient to make further provision for the safety of passengers by the said ships ; Be it therefore enacted,

by His Excellency the Governor of Western Australia and its

Dependencies, by and with the advice and consent of the Legislative

Council thereof, as follows:—

Passengers' Ordinance—Amendment.

Short title.

1 THIS Act may be cited as " The Colonial Passengers' Ordinance Amendment Act, 1876," and shall be taken and con- strued as part of the said last recited Ordinance.

Coasting vessels to carry

2 EVERY ship or vessel to which the said Ordinance of 1861

certificated mates. is applicable shall, if she carry passengers on any voyage beyond Cape

Naturalists to the South, or beyond the North West Cape to the North, in addition to a competent master and an efficient crew, carry a mate possessing a mate's certificate from the Board of Trade, or, in the absence of such, a certificate from the Local Board hereinafter

named. And any master of any such ship or vessel who shall go

to sea on any such voyage as aforesaid without having on board a mate holding a certificate as aforesaid, and the owner or owners of any such ship or vessel, shall be guilty of an offence, and shall for such offence incur a•penalty not exceeding Fifty pounds.

Such ships also to carry aNO such ship or vessel shall go to sea on any such voyage chronometer. as aforesaid without having on board a chronometer in proper

working order to the satisfaction of the Superintendent of Water Police or other person or persons appointed by the Governor to carry the said Ordinance of 1861 into execution ; and any master of any such ship or vessel who shall go to sea on any such voyage as aforesaid without such chronometer in proper working order as aforesaid, and the owner or owners of any such ship or vessel, shall be guilty of an offence, and shall for such offence incur a penalty not exceeding Fifty pounds.

Provision as to granting 4 THE provisions contained in the third, fourth, and fifth

local certificates to mates. sections of the said recited Ordinance of 1868 are hereby made

applicable to mates as if they were here repeated, with the substitution of the word "mates" or "mate" for the word "masters" or " master," whenever the last-mentioned words occur.

Date of operation.

5 THIS Act shall come into operation on the First day of

August next.
