Limited Act of 1928," in certain COLGOANSIAL ASSOCIATION particulars. LIMITED ACT AMENDMENT ACT OF 1958. [ASSENTED TO 7TH OCTOBER, 1958.] B E it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legis- lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows :- 1 . (1.) This Act may be cited as " The Colonial Gas Short title. Association Limited Act Amendment Act of 1958." (2.) *" The Colonial Gas Association Limited Act of Principal 1928" is in this Act referred to as the Principal Act. Act. (3.) The Principal Act and this Act may be collective collectively cited as " The Colonial Gas Association title ' Limited Acts, 1928 to 1958." 2. Section forty-nine of the Principal Act is amended Amendment by repealing the final paragraph thereof (being the of a. 49' paragraph commencing with the words "Every reference ") and inserting, in lieu of that repealed paragraph, the following paragraph, namely :— "References in this Act to "the town of Sandgate ", "the town of Sandgate and its suburbs ", and "the town of Sandgate aforesaid or its suburbs ", shall be taken on and after the passing of f" The Colonial Gas Association Limited Act Amendment Act of 1958," to refer to the Area set out in the Schedule to this Act." 3. The following section is inserted after section New s. 49A forty-nine of the Principal Act, namely :— inserted. "[49A.] (1.) Subject to this section, the Governor Power of in Council may from time to time, by Order in Council goouvnecriiiio.r in published in the Gazette, amend the Schedule to this Act— (a) By excluding from the Area set out therein any part of that Area; or * 19 G. 5. t This Act.

(b) By including in the Area set out therein any other area not already included in that Area, and the said Schedule as so amended shall thereupon become for the time being the Schedule to this Act and shall have effect accordingly. (2.) The Governor in Council shall not, pursuant to this section, exclude from the Area set out in the Schedule to this Act any part of that Area, or include in that Area any area not already included therein, save with the prior consent in writing of the Company. (3.) The Governor in Council shall not, pursuant to this section, include in the Area set out in the Schedule to this Act any area not already included therein wherein any person other than the Company is authorised under an Act to supply gas save with the prior consent in writing of that person. For the purposes of this subsection a person shall be deemed to be not authorised by an Act to supply gas in an area which is not expressly set out in the Act in question." Repeal of and new Schedule. SCHEDULE. 4. The Schedule to the Principal Act is repealed and, in lieu of that repealed Schedule, the following Schedule is inserted :— "SCHEDULE. BOUNDARIES OF THE AREA. Commencing at a point on the northern bank of Serpentine Creek at the mouth; thence along the foreshores of Moreton Bay at high water mark in a generally north-westerly direction to the mouth of the Pine River; thence along the boundary of the city of Brisbane as defined by " The City of Brisbane Acts, 1924 to 1958," in a south- westerly and westerly direction to the intersection of the boundary of the city of Brisbane as defined by " The City of Brisbane Acts, 1924 to 1958," and the northern side of Albany Creek road; thence along the northern side of Albany Creek road in an easterly direction to the intersection of Albany Creek road and the northern bank of Cabbage Tree Creek; thence along the northern bank of Cabbage Tree Creek to its intersection with Beams road thence along the northern side of Beams road in an easterly direction to its intersection with Sandgate road; thence along the south-western side of Sandgate road in a south-easterly direction to the intersection of Sandgate road and a watercourse known as Zillman Waterholes ; thence along the northern side of the watercourse known as Zillman Waterholes and Nundah Creek in an easterly and northerly direction to the intersection of Nundah Creek and Queen's road; thence along the north-eastern side

Act may be collectively cited as " The South Brisbane Gas and Light Company, Limited, Acts, 1885 to 1958." 2. Section thirty-seven of the Principal Act is Aofms.en3d7m. ents amended— (a) By repealing therein all words assigning a meaning to the words "Local Authority" and inserting, in lieu of the words so repealed, the words "The words "Local Authority" shall mean Brisbane City Council under and within the meaning of t" The City of Brisbane Acts, 1924 to 1958."
