An Act to amend the Law wi th respect to the Distillation and Exporta t ion of Spirits dis­ tilled in the Colony of New South Wales. [1st October, 1850.]

WH E R E A S by an Act of t he Governor a n d Legis la t ive Council of N e w South W a l e s passed in t h e t h i r t e e n t h year of H e r
Majesty 's re ign in t i tu led " An Act to consolidate and amend the Laws
" relating to the distillation rectifying and compounding of Spirits and
" to authorize and regulate the warehousing under bond and the

" exportation free of duty of Spirits distilled within the Colony of " New South Wales and to repeal certain Laws relating thereto " p ro ­ vision is made for t h e warehous ing u n d e r bond a n d the expor ta t ion of spiri ts distilled in t h e Colony w i t h o u t p a y m e n t of d u t y A n d whereas

i t is expedient to pe rmi t t h e expor ta t ion of such spir i ts direct from
t h e certified and regis tered store a t t ached to any dist i l lery for t h e
reception of spir i ts w h e n distilled Be i t therefore enacted by H i s
Excel lency t h e Governor of N e w South W a l e s w i th t h e advice and
is the mate r ia l to be distilled from and such wine has been t aken from t h e

consent of t h e Legislat ive Counci l thereof T h a t i t shall be lawful to remove any such spir i ts from t h e certified and regis tered s tore as aforesaid and to ship t h e same in any ship or vessel for removal to any por t w i th in t h e boundar ies of t h e said Colony or for expor t to places beyond the boundar ies of t h e Colony u p o n t h e distiller or expor ter en te r ing in to t he l ike bonds a n d pass ing t h e l ike entr ies as a re by t h e said A c t requ i red to be entered in to a n d passed wi th respect to spir i ts distilled in t h e Colony and removed from a bonded warehouse for ship­ m e n t e i ther t o any por t wi th in t h e boundar ies of t he Colony or to places beyond the boundar ies thereof as t he case may be.

2. A n d be it enacted Tha t t h e r e t u r n of Colonial disti l led spiri ts

which by the n ine ty -e igh th clause of t h e said recited A c t is directed to be made a n d publ ished wi th in one m o n t h after t h e thi r ty-f i rs t day of December in each year shal l i n addi t ion to t he par t i cu la rs there in directed conta in a s t a t emen t of all Colonial distilled spir i ts exported du r ing the previous year direct i rom such regis tered stores as aforesaid unde r t h e provisions of th is Ac t wi thout hav ing been warehoused.

3.    A n d be i t enacted T h a t in all l icensed disti l leries where wine

t he store certified and registered for t h e reception of ma te r i a l to be used in t he process of dis t i l la t ion to any disti l lery it shall be lawful for t h e disti l ler a t his discretion e i ther to convey the said wine in to t he under -back or m a s h - t u n of t he dist i l lery or to p u m p i t in to t he wash charger wi th in one hou r after it is received from the said s tore.

4.     Provided a lways a n d be i t enacted T h a t all such wine shall

u p o n its receipt in to t he certified a n d registered store as aforesaid and also on i ts removal therefrom for t h e purpose of disti l lation be gauged in t he presence and to t h e satisfaction of an Inspec tor of Disti l leries who shal l t ake an account thereof.
