417 OUMSIMib ANNO VICESIMO QUARTO ELIZABETH AE SECUNDAE REGINAE An Act to make further provision with respect to the appoint- ment and constitution of a committee for the purpose of carrying out the terms of a trust provided for in the will of the late Colonel Daniel Edward Evans [AssENTED T o 17TH SEPTEMBER, 1975] Preamble . Whereas the committee appointed to choose beneficiaries of the educational bursary known as The William Parry Memorial " is by virtue of the terms of the will of the late Colonel Daniel Edward Evans to comprise a director and foreman engineer of the Bundaberg Foundry preferably officers who have served under the late William Parry and a representative of the Queensland Department of Education preferably a representative dealing with technical training: And whereas with the passing of time it has become increasingly difficult to find officers of the Bundaberg Foundry who have served under the late William Parry: And whereas it is desirable that other provision be made for the composition of the said committee:
418 Colonel Evans (William Parry Memorial Bursary) Act BE IT THEREFORE ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Short title and construction . This Act may be cited as the Colonel Daniel Edward Evans (William Parry Memorial Bursary) Act 1975 and shall be read as one with The Colonel Daniel Edward Evans (William Parry Memorial Bursary) Act of 1960. 2. Interpretation . In this Act, unless the contrary intention appears- committee " means the committee required by the terms of the will of the late Colonel Daniel Edward Evans to be appointed by the trustee for the purpose of administering the trust that provides for the educational bursary known as " The William Parry Memorial "; " trustee " means the executor and trustee named in the will of the late Colonel Daniel Edward Evans, namely The Union-Fidelity Trustee Company of Australia Limited (being the successor of The Union Trustee Company of Australia Limited). 3. Appointment of committee . (1) Any committee appointed by the trustee after the passing of this Act, shall consist of three members of whom- (a) two shall be persons nominated by the board of directors of The Bundaberg Foundry Company Limited, of whom one shall be preferably a person associated with the engineering trades or profession; (b) one shall be an officer of the Department of Education of Queensland, who shall be preferably a person involved with technical training. (2) If- (a) in the opinion of the board of directors there is not a person associated with the engineering trades or profession who is readily available for nomination to the committee the board of directors may nominate to the committee a person other than such a person, who in its opinion is suitable; (b) in_ the trustee 's opinion a person involved with technical training , being an officer of the Department of Education, is not readily available for appointment to the committee the trustee may appoint to the committee an officer of that Department who in the trustee 's opinion is suitable. (3) A committee constituted and appointed as prescribed by subsection (1) shall be deemed to be constituted and appointed in accordance with the terms of the will of the late Colonel Daniel Edward Evans , any provision of that will notwithstanding. 4. Term of committee' s appointment . (1) The members who constitute the committee at the passing of this Act or who at any time thereafter constitute the committee shall hold office as such members at the pleasure of the trustee.
Colonel Evans ( William Parry Memorial Bursary ) Act 419 (2) The trustee may at any time, without giving any reason therefor, upon giving 14 days notice in writing to the member or members of the committee concerned, remove a member or the members of the committee from office as such. (3) The removal by the trustee of a member of the committee from his office as such shall not be questioned in any proceeding whatever.
