STATEMENT OF DECISION AND REASONS

APPLICATION FOR REVIEW

  1. This is an application for review of a decision made by a delegate of the Minister for Immigration and Border Protection on 13 March 2017 to refuse to approve the applicant’s nomination under s.140GB of the Migration Act 1958 (‘the Act’) and r.2.72 of the Migration Regulations 1994 (‘the Regulations’).

  2. The applicant, Colombicoff Holdings Pty Ltd ATF The James Family Trust, applied for approval on 15 July 2016. A nomination of an occupation for a Subclass 457 visa is made under s.140GB of the Act and r.2.73 of the Regulations. Regulations 2.72(3) to (12) prescribe the criteria that must be satisfied for the Minister to approve a nomination by a person. These criteria are extracted in the attachment to this decision. For nomination applications made from 23 November 2013, additional criteria are specified in s.140GBA.

  3. The delegate decided not to approve the nomination on the basis that the applicant did not satisfy r.2.72(10)(aa) due to a lack of satisfaction that the actual tasks of the position align to the nominated occupation of Accountant (General) (ANZSCO 221111). Rather, the delegate formed the view that the tasks of the position were more akin to that of a Bookkeeper (ANZSCO 551211), Accounts Clerk (ANZSCO 614111) or a Payroll Clerk (ANZSCO 614211). These occupations do not correspond to an occupation specified by the Minister for the purposes of making a valid nomination.

  4. On 25 October 2018, the Tribunal wrote to the applicant pursuant to subsection 359(2) of the Act inviting them to provide current information addressing the relevant criteria under r.2.72 of the Regulations and s.140GB of the Act. The Tribunal is satisfied that this invitation was properly despatched to the email address of the applicant’s registered migration agent. The applicant failed to provide the information within the prescribed time for responding to the invitation. No response to that invitation has ever been received by the Tribunal.

  5. Where a review applicant is invited to provide further information in accordance with subsection 359(2) of the Act, and fails to do so within the prescribed period, the Tribunal may make a decision on the review without taking any further action to obtain the information according to subsection 359C(1) of the Act. In these circumstances, the review applicant is not entitled to appear before the Tribunal in accordance with subsection 360(3) of the Act. Of note, the effect of section 363A of the Act is that if a review applicant has no entitlement to a hearing, the Tribunal has no power to permit the review applicant to appear before it as outlined in the Full Federal Court authority in the matter of Hasran v MIAC [2010] FCAFC 40.

  6. Although the applicant has not requested this, the Tribunal has also considered whether it would be appropriate to adjourn the application for review under subsection 363(1)(b) of the Act to allow the applicant additional time in which to provide evidence to support its application for review. The Tribunal has taken into account the fact that the applicant has been aware since 13 March 2017 of the reasons for the nomination application being refused and also that the implications of not providing the information requested in the invitation from the Tribunal of 25 October 2018 were clearly set out in that correspondence. Further, the Tribunal has considered that the applicant is represented by a registered migration agent.

  7. In these circumstances, the Tribunal considers that the applicant has had sufficient time in which to address the central issues arising in the application for review. Accordingly, the Tribunal has decided not to exercise its discretion under subsection 363(1)(b) of the Act to adjourn the review any further to allow the applicant more time in which to demonstrate that it meets the relevant criteria under r.2.72 of the Regulations and s.140GB of the Act.

  8. Following careful consideration, the Tribunal has decided to proceed to make a decision on this review without taking any further action to obtain the information referred to in the aforementioned invitation.

  9. For the following reasons, the Tribunal has decided to affirm the decision under review not to approve the nomination.

    CONSIDERATION OF CLAIMS AND EVIDENCE

  10. The issue in the present case is whether the applicant meets the criteria for approval of the nomination. The Tribunal must approve the nomination if the applicant is an approved sponsor and meets the requirements in r.2.72: s.140GB(2). In addition, for nominations made from 23 November 2013, s.140GBA must be met.

    Specified occupation

  11. Subclause 2.72(10)(aa) as it applies in this case, requires that the nominated occupation and its 6-digit code correspond to an occupation and 6-digit code specified in instrument IMMI 17/060, and the occupation must be applicable to the person identified in the nomination in accordance with the instrument. In certain circumstances, this instrument may also require the nomination of an occupation to be supported in writing to the Minister, by a specified organisation before the nomination can be approved: r.2.72(10)(b).

  12. The applicant has nominated the occupation of Accountant (General) (ANZSCO 221111), which is specified in the relevant instrument. The nominee for the position is Ms Maricella Chavez Castaneda. However, as previously outlined, the delegate formed the view that the tasks of the position were more akin to that of a Bookkeeper (ANZSCO 551211), Accounts Clerk (ANZSCO 614111) or a Payroll Clerk (ANZSCO 614211) and these occupations are not specified in the relevant instrument.

  13. The Tribunal has carefully considered the documentary evidence before it in relation to the nominated occupation. Additionally, the Tribunal has had regard to the tasks stipulated in ANZSCO with respect to the nominated occupation of Accountant (General) (ANZSCO 221111), noting that these are referred to in the delegate’s primary decision.

  14. The Tribunal notes that the applicant submitted information to the Department in connection with its nomination application, including but not limited to, a position description, employee agreement (with tasks outlined), a submission in support of the nomination entitled ‘Colombicoff Holdings Pty Ltd T/A Harbour Seafood Market’ (which refers to matters such as business and personnel structures and the need for the position), and financial records.

  15. The Tribunal notes in various portions of the above mentioned documentary evidence the applicant makes reference to the description and duties or tasks of the position. Whilst the Tribunal accepts that some elements of the tasks associated with the nominated position accord with the ANZSCO tasks for an Accountant (General) (ANZSZO 221111), the bulk are lower order processing and administrative tasks associated with consumer financial transactions and the payment of employees. These include, “processes client information and data entry into accounting software”, “ completes payroll, wage declaration and superfunds for employees at end of Financial year”, and “processes orders, invoices, management purchases orders, suppliers’ documentation”. When such tasks are considered in conjunction with the scope of the applicant’s business and its personnel structure, the Tribunal forms the view that the nominated position does not actually involve the majority of higher order tasks commensurate with the role of an Accountant (General) (ANZSCO 221111). Rather, the position is more akin to the lower level positions identified by the delegate and referred to above.

  16. It is worth pausing to reflect that the applicant was invited to provide further information to the Tribunal pursuant to s.359(2) of the Act but failed to do so. On balance, the Tribunal is not satisfied that the nominated occupation and its 6-digit code correspond to an occupation and 6-digit code specified in instrument IMMI 17/060. Accordingly, the Tribunal finds that the requirements of r.2.72(10)(aa) are not met.

  17. For the reasons given above, the Tribunal is not satisfied that the applicant meets the applicable criteria for the nomination to be approved. Accordingly, the decision under review must be affirmed.

    DECISION

  18. The Tribunal affirms the decision not to approve the nomination.
