AN ACT to validate certain Rates made by the Council of the Municipality of Collie and the Collie Local Board of Health, for the year ending the thirty-first day of October, 1905, and to validate the confirmation of the report of the Special Auditor for the Municipality of Esperance.

[Assented to 27th August, 1906.]

DE it enacted by the King's Most Excellent Majesty, by and .1.210with the advice and consent of the Legislative Council and Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

1. The general rate and the health rate, struck or purporting to have been struck by the Council of the Municipality of Collie, and the Collie Local Board of Health, respectively, for the year ending the thirty-first day of October, one thousand nine hundred and five, shall be deemed to have beem lawfully struck ; and all things necessary to be done in and towards the striking of such rates shall be deemed to have been duly performed, notwithstanding any

failure to comply with any of the provisions of the Municipal Institutions Act, 1900, or the Health Act, 1898, relating thereto ; and the said rates may be recovered accordingly, as if the provisions of the said Acts were in all respects complied with.

2. The confirmation by the Governor, by notice in the

firmation of report Government Gazette, published on the twenty-second day of June,of special auditor for Esperance. one thousand nine hundred and six, of the report dated the thirteenth

day of January, one thousand nine hundred and six, of the special auditor appointed for the Municipality of Esperance, shall for all purposes be as good and valid as if such confirmation had been made and published within three months after the date of the said report, and such report shall be deemed to have been duly confirmed under the provisions of Part XXI. of the Municipal Institutions Act, 1900.
