1—Short title

These regulations may be cited as the Collections for Charitable Purposes (Collection Bins) Regulations 1995.

2—Commencement

These regulations will come into operation on 1 January 1996.

3—Interpretation

In these regulations, unless the contrary intention appears—

the Act means the Collections for Charitable Purposes Act 1939;

collection bin means a receptacle left in a public place to enable members of the public to dispose of unwanted goods;

commercial collection bin means a collection bin that a person who does not hold a licence under section 6 of the Act uses to collect unwanted goods.

4—Information to be displayed on commercial collection bins

(1)One or other of the following statements must be displayed on the upper half of commercial collection bins:

"COMMERCIAL COLLECTION BIN"

"COMMERCIAL RECYCLE CLOTHING BIN".

(2)The statement must be displayed on as many parts of the bin as is necessary to enable a person approaching the bin at ground level from any direction to read the statement.

(3)No other information may be displayed on the upper half of a commercial collection bin whether by words, pictures, symbols or any other means except with the approval of the Minister.

(4)The name and address of the person using a commercial collection bin to collect unwanted goods must be displayed on the lower half of the bin and a telephone number for that person may also be displayed on the lower half of the bin.

(5)No information may be displayed on a commercial collection bin, whether by words, pictures, symbols or any other means, except—

(a)information that is required or permitted to be displayed on the bin by subregulation (1) or (4); or

(b)information approved by the Minister in respect of a particular bin or bins.

(6)The letters used in the statement displayed on the upper half of a commercial collection bin must be at least five centimetres in height.

(7)The letters and numerals comprising the name and address of the person using a commercial collection bin must be 25 millimetres in height and none of the other letters and numerals displayed on the lower half of the bin may exceed that height.

(8)All the letters and numerals displayed on a commercial collection bin must be the same colour and tone which must contrast with the background colour and tone of the bin so that they are clearly legible.

(9)A person who uses a commercial collection bin to collect unwanted goods is guilty of an offence if the bin does not comply with this regulation.

Maximum Penalty: $2 000
