The court ultimately preferred the opinion of Dr Stokes, finding that while an aggravation of degenerative arthritis had occurred, it was not satisfied on the balance of probabilities that this condition arose out of or in the course of the applicant's employment.

The court affirmed the decision of Comcare, finding that the applicant had not established that his employment contributed to a significant degree to the aggravation of his left knee condition. Therefore, Comcare was not liable to pay compensation.
