I, the Minister for Planning, make the following local environmental plan under the
Environmental Planning and Assessment Act 1979.

1 Name of Plan
This Plan is Coffs Harbour Local Environmental Plan 2013 (Amendment No 9).
2 Commencement
This Plan commences on the day on which it is published on the NSW legislation website.
3 Land to which Plan applies
This Plan applies to certain land to which Coffs Harbour Local Environmental Plan 2013 applies, including land in Zone RU2 Rural Landscape, and the following land:
| (a) | certain land located on and adjacent to the Pacific Highway between the Lyons Road interchange and the southern boundary of the Coffs Harbour City local government area, Bonville, |
| (b) | part of the land at the Coffs Harbour Airport, |
| (c) | a road reserve adjacent to Lots 1000 and 1001, DP 777881, 72 East Bank Road, Coramba, |
| (d) | Lot 4, DP 1196909, 30 Blackadder Road, Corindi, |
| (e) | part of Lot 340, DP 1069505, Diggers Beach Road, Diggers Beach, |
| (f) | part of Lot 1, DP 805204, part of Lots 1 and 2, DP 202529 and part of Lot 8, DP 560317, being part of 2–10 Hunter Close, Korora, |

4 Maps
The maps adopted by Coffs Harbour Local Environmental Plan 2013 are amended
or replaced, as the case requires, by the maps approved by the Minister on the making
of this Plan.

[1] Clause 7.6A
Insert after clause 7.6:
| 7.6A | Water bottling facilities on land in Zone RU2 Rural Landscape | |||

development consent for the purposes of a water bottling facility on land in
Zone RU2 Rural Landscape if the consent authority is satisfied that the
development will not have an adverse impact on natural water systems or the
potential agricultural use of the land.
| (3) | Despite any other provision of this Plan, development may be carried out with |
| development consent for the construction of a pipe or similar structure on any land for the purposes of conveying groundwater to a water bottling facility. | |
| (4) | In this clause: water bottling facility means a building or place at which groundwater from land in Zone RU2 Rural Landscape is extracted, handled, treated, processed, stored or packed for commercial purposes. |
