I, the Minister for Planning, make the following local environmental plan under the

Environmental Planning and Assessment Act 1979.

1      Name of Plan

This Plan is Coffs Harbour Local Environmental Plan 2013 (Amendment No 12).

2      Commencement

This Plan commences on the day on which it is published on the NSW legislation website.

3      Land to which Plan applies

This Plan applies to land at 6, 6A, 6B and 10 North Boambee Road, North Boambee

Valley, being Lot 3, DP 1022408 and Lots 120–122, DP 1184992.

4      Maps

The maps adopted by Coffs Harbour Local Environmental Plan 2013 are amended or replaced, as the case requires, by the maps approved by the Minister on the making of this Plan.

5 Amendment of Coffs Harbour Local Environmental Plan 2013

Schedule 1 Additional permitted uses

Insert after clause 20:

21      Use of certain land at North Boambee Road, North Boambee Valley

(1)

This clause applies to land at 6, 6A, 6B and 10 North Boambee Road, North Boambee Valley, being Lot 3, DP 1022408 and Lots 120–122, DP 1184992, shown as “21” on the Additional Permitted Uses Map.

(2)

Development for the purpose of a vehicle sales or hire premises is

permitted with development consent.

(3)

Development consent must not be granted under subclause (2) after 5 years from the commencement of Coffs Harbour Local

Environmental Plan 2013 (Amendment No 12) for development on land

at 6B or 10 North Boambee Road, North Boambee Valley, being Lot 3,

DP 1022408 and Lot 120, DP 1184992.
