I, the Minister for Planning, make the following local environmental plan under the

1      Name of Plan

This Plan is Coffs Harbour Local Environmental Plan 2013 (Amendment No 11).

2      Commencement

This Plan commences on the day on which it is published on the NSW legislation website.

3      Land to which Plan applies

This Plan applies to Lot 1, DP 777555, 1 Hamilton Drive, Boambee East.

4      Maps

The maps adopted by Coffs Harbour Local Environmental Plan 2013 are amended or replaced, as the case requires, by the maps approved by the Minister on the making of this Plan.

5 Amendment of Coffs Harbour Local Environmental Plan 2013

Schedule 1 Additional permitted uses

Insert after clause 19:

20      Use of certain land at Hamilton Drive, Boambee East

(1)

This clause applies to land at 1 Hamilton Drive, Boambee East, being Lot 1, DP 777555, shown as “20” on the Additional Permitted Uses Map.

(2)

Development for the purpose of landscaping material supplies is

permitted with development consent.

(3)

The consent authority must not consent to development referred to in

subclause (2) unless conditions are imposed to the effect that:

(a)

the development is to cease no later than 30 years after the date on which development consent is first granted in respect of the development, and

(b)

the infrastructure and materials associated with landscaping material supplies are to be removed from that part of Zone E2 that lies outside of the land to which this clause applies in accordance with the Voluntary Planning Agreement and the Vegetation Management Plan that apply to Lot 1, DP 777555, 1 Hamilton Drive, Boambee East.
