1 Name of plan
This plan is Coffs Harbour City Local Environmental Plan 2000
(Amendment No 37).
2 Aims of plan
This plan aims to amend Coffs Harbour City Local Environmental Plan
2000 so as:
| (a) | to rezone the land to which this plan applies to the Residential 2E Tourist Zone to allow residential and tourism-related uses of the land, and |
| (b) | to provide that any subdivision of, or erection of a dwelling on, that land is to be in accordance with the Big Banana/Summit Lands Development Control Plan (as in force on the commencement of this plan). |
3 Land to which plan applies
This plan applies to land within the City of Coffs Harbour near the Big Banana, in the vicinity of Pinnacle Way, Coffs Harbour, as shown coloured with pink stripes and lettered “2E” on the map marked “Coffs Harbour City Local Environmental Plan 2000 (Amendment No 37)” deposited in the office of Coffs Harbour City Council.

Insert after clause 18:

Objective of provision
To allow the subdivision of, and erection of dwellings on, land in accordance with a development control plan.
| (1) | This clause applies to land near the Big Banana, in the vicinity of Pinnacle Way, Coffs Harbour, as shown coloured with pink stripes and lettered “2E” on the map marked “Coffs Harbour City Local Environmental Plan 2000 (Amendment No 37)”. |
| (2) | Consent must not be granted for the subdivision of, or erection of a dwelling on, land to which this clause applies unless the consent authority is satisfied that the subdivision or erection of a dwelling is in accordance with the Big Banana/Summit Lands Development Control Plan as in force on the commencement of Coffs Harbour City Local Environmental Plan 2000 (Amendment No 37). |
