Environmental Planning and Assessment Act 1979

1      Name of plan

This plan is Coffs Harbour City Local Environmental Plan 2000

(Amendment No 32).

2      Aims of plan

(1) This plan aims to amend Coffs Harbour City Local Environmental Plan

2000:

(a)	to include land (the land) to which part of Ulmarra Local Environmental Plan 1992 previously applied so that the controls applying to the land are consistent with those elsewhere in the City of Coffs Harbour, and
(b)	to rezone the land so as to recognise and provide for a variety of land uses, including agricultural, rural, residential, recreational, environmental protection and national parks and nature reserves, and
(c)	to recognise part of the land as being archaeological sites of Aboriginal significance, and
(d)	to recognise part of the land as heritage items.

(2)

This plan also consequently amends Ulmarra Local Environmental

Plan 1992.

3      Land to which plan applies

(1)

In respect of the aims set out in clause 2 (1) (a) and (b) and (2), this plan applies to land shown distinctively coloured on Sheets 1–3 of the map marked “Coffs Harbour City Local Environmental Plan 2000 (Amendment No 32)” (the amending map) deposited in the office of Coffs Harbour City Council.

In respect of the aim set out in clause 2 (1) (c), this plan applies to land

shown edged heavy black on Sheet 4 of the amending map.

(3)

In respect of the aim set out in clause 2 (1) (d), this plan applies to land

referred to in Schedule 1 [3] to this plan.

[1]      Clause 9 How does the development control table work?

Insert at the end of item 1 of the matter relating to the Environmental

Protection 7A Habitat and Catchment Zone in the Table to the clause:

• to enable protection of archaeological sites of Aboriginal significance.

[2]      Clause 21 Heritage

Insert after clause 21 (7):

(7A) Despite any other provision of this plan, a person must not, except with development consent, carry out development for the purposes of agriculture or environmental protection works on land within Zone 1A that is an archaeological site of Aboriginal significance shown as such within the area shown edged heavy black on Sheet 4 of the map marked “Coffs Harbour City Local Environmental Plan 2000 (Amendment No 32)”.
