COFF'S HARBOUR BOAT-HARBOUR WORKS

Act No. 23, 1972.
An Act to sanction and provide for the carrying out of certain works in connection with the construction of a new boat-harbour at Coff's Harbour including dredging and reclamation work; to authorise the Minister to carry out the work; to amend the Public Works Act, 1912; and for purposes connected therewith. This Act may be cited as the "Coff's Harbour Boat- harbour Works Act, 1972".
1.
(1 ) In this Act "scheduled works" means the works described in the Schedule to this Act, subject to such modi fications and deviations as may be deemed necessary or desirable by the Minister.

(2) The site of the scheduled works is shown on the plan marked "Coff's Harbour Boatharbour" signed by the Minister, countersigned by the Director of Public Works and deposited in the public office of the Minister.
(1) The carrying out of the scheduled works is hereby
sanctioned.
(2) The Minister is empowered to carry out the scheduled works and for the purpose of so doing may do all such things, including entering into contracts, as he may consider necessary.
The cost of carrying out the scheduled works which, exclusive of land exchanges and land acquisitions, is estimated

| more than ten per centum. at eight hundred thousand dollars, shall not be exceeded by | 5. (1) The scheduled works shall be deemed to be authorised works within the meaning of the Public Works |
| (2) For the purpose of the scheduled works the Minister shall be the Constructing Authority within the meaning of the Act. |
(3)
(3) The provisions of the Act, other than sections
Thirty-four, thirty-five, thirty-six and thirty-seven thereof, shall
apply to and in respect of the scheduled works.(4 ) Without prejudice to the generality of the other provisions of this section the provisions of section thirty-eight of the Act shall apply to and in respect of a contract made OR to be made under subsection two of section three of this
Act.
SCHEDULE.
DESCRIPTION OF WORKS.
1. The construction of a breakwater approximately one thousand two hundred and thirty feet long in a north-westerly direction from Mutton Bird Island.
2. The construction of a retaining wall approximately one
thousand five hundred and fifty feet long at the north-west corner
of Coff's Harbour.3. The dredging of an area of approximately thirteen acres from the northern part of Coff's Harbour which will form part of the new boat-harbour.
4. The reclamation of an area of approximately five and a half acres at the north-west corner of Coff's Harbour with materials from
the dredging works referred to in item 3 of this Schedule. 5. The construction of a breakwater approximately five hundred and fifty feet long in a south-easterly direction from the reclaimed land referred to in item 4 of this Schedule.
6. The construction of a concrete wharf approximately one hundred
and twenty feet long and approximately thirty feet wide at the eastern
extremity of the reclaimed land referred to in item 4 of this Schedule.7. The construction of mooring facilities for fishing vessels within the new boat-harbour.
8. Associated works as may be deemed necessary or desirable by
the Minister.
9. Works for the protection of the environment as may be deemed necessary or desirable by the Minister as a consequence of the carry ing out of any of the works referred to in items 1 to 8 (inclusive) of this Schedule.
