CaseChat Overview and Summary
The primary legal issues before the Commission were whether the agreement had been made in accordance with the Fair Work Act 2009 and whether it satisfied the procedural fairness requirements. The Commission needed to determine whether the company had appropriately engaged with the employees and whether the process leading to the agreement was transparent and fair. Additionally, the Commission had to assess whether the terms of the agreement complied with the provisions of the Fair Work Act.
After considering the evidence and submissions from both parties, the Commission found that the agreement was procedurally fair and had been made in good faith. The Commission noted the company's efforts to consult with the employees and their representatives, which were deemed adequate. Furthermore, the terms of the agreement were found to be consistent with the provisions of the Fair Work Act and met the statutory requirements. Consequently, the Commission approved the Coca-Cola Europacific Partners Preform and Closures Plant Eastern Creek Enterprise Agreement 2021-2023.
