s1 2 s4 Coal Mining (Underground Coal Mines) General Amendment (No. 1) No. 331, 1999 ˙ Short title 1. This regulation may be cited as the Coal Mining (Underground Coal Mines) General Amendment Regulation (No. 1) 1999 . ˙ Rule amended 2. This regulation amends the Coal Mining (Underground Coal Mines) General Rule 1983 . ˙ Amendment of s 2.7 3.(1) Section 2.7(2), ‘The provisions of paragraph 2.7(1)(a) shall’— omit, insert— ‘Subsection (1) does’. (2) Section 2.7(3), ‘Subject to paragraph 2.7(1)(b)’— omit, insert— ‘Subject to subsection (1) and section 2.12(2)’. ˙ Insertion of new pt 2A 4. After part 2— insert— ‘ PART 2A—HAZARD MANAGEMENT PLANS FOR THERMAL ENVIRONMENTS ˙ ‘ Definitions for pt 2A ‘ 2.11 In this part— “approved standard” means the document entitled ‘Approved Standard for the Management of Heat in Underground Coal Mines QMD 99 7460’. “hazard management plan” , for the thermal environment in an underground workplace at a mine, means a written plan for the mine
s4 3 s4 Coal Mining (Underground Coal Mines) General Amendment (No. 1) No. 331, 1999 that complies with the approved standard and provides for the following— (a) appropriate workplace environment controls in underground workplaces; Example of an‘appropriate workplace environment control’— Equipment to control ventilation, humidity or heat in the workplace. (b) monitoring thermal conditions in underground workplaces; (c) training about how to avoid harmful effects of heat; (d) monitoring the health of persons who work in thermal conditions mentioned in section 2.12(1); (e) the use, maintenance and calibration of appropriate equipment for measuring thermal conditions in underground workplaces; (f) training for persons required to use equipment mentioned in paragraph (e); (g) walking and travelling arrangements; (h) how a person may be engaged in work in an underground workplace to— (i) reduce the effective temperature of the workplace below 29.4°C; or (ii) to increase air movement in the workplace to not less than 15.2 m per minute; (i) emergency and rescue procedures. ˙ ‘ Mines may have a hazard management plan ‘ 2.12(1) A mine may have a hazard management plan for the thermal environment in an underground workplace at the mine if— (a) the temperature in the workplace exceeds 27°C wet bulb; or (b) the manager of the mine or an inspector believes the thermal environment in the workplace is likely to be harmful to a person’s health.
s4 4 s4 Coal Mining (Underground Coal Mines) General Amendment (No. 1) No. 331, 1999 ‘ (2) If the mine has a hazard management plan, section 2.7(3) and (4) does not apply to the mine. ˙ ‘ Contravention of hazard management plan ‘ 2.13 A person must not contravene a hazard management plan. Maximum penalty—2 penalty units. ˙ ‘ Hazard management plan reviews ‘ 2.14(1) An inspector may give the manager of a mine a written direction to review the mine’s hazard management plan if the inspector considers the plan does not adequately provide for a matter mentioned in section 2.11(a) to (i). ‘ (2) The direction must state the matter the inspector considers is not adequately provided for in the plan. ‘ (3) The manager must review the plan as directed and, as soon as practicable after the review, ensure the plan adequately provides for the matter. Maximum penalty—2 penalty units. ˙ ‘ Hazard management plan must be given to employers ‘ 2.15 The manager must give a copy of the mine’s hazard management plan to an employer of persons at the mine whose work is affected under the plan. Maximum penalty—2 penalty units. ˙ ‘ Employees may request copy of hazard management plan ‘ 2.16 The manager must give a copy of the mine’s hazard management plan to an employee who works at the mine if the employee asks for a copy. Maximum penalty—2 penalty units.’.
